Whilst I do not want to get into an arguement with any poster I must say to K Butt that if a person of any age climbed over any fence or passed through a gate onto private property with the intent to recover a ball etc that would NOT be a criminal offence . To prove a criminal offence one of the requirements must be intent to do a criminal,act.

     

    I don't mind a good argument, if you enter another persons land without their permission you are trespassing! 

     

    How to bring a trespass claim:
     
    In order to bring a claim for trespass there must be direct and unjustifiable interference with somebody’s land. This can occur in a number of ways, with the most common example being jumping over a fence to retrieve a football.

    I read this lot earlier on another forum that might be worth reading. If you were a guest staying in this hotel in one of the chalets at the back and you were robbed or your belongings stolen while you were out having dinner because the barbed wire had to be removed, I am sure you would have had no objection to some barbed wire being in place to help prevent this sort of crime in the first place.

  2. The bard wire does not stop people climbing over the fence until they come into contact with it . One type of incident which comes to mind is kids playing football alongside this fence and their ball goes over the fence , one of the first things a kid will do is to try and reclaim his ball . Not a criminal offence but the kid could be injured. Likewise a cat could also be injured climbing over.

     

    Having said all that I would protect my property in anyway I could to prevent "criminals" from entering it. There are legal ways to use bard wire on a fence.

     

    Climbing over the fence would be classed as a criminal offence and you could not only cause criminal damage in the process but you would be trespassing. The barbed wire acts as a deterrent and anyone who can see it if they had any sense would stay away not proceed to climb over it. 

  3. The flats in Beatie avenue were built about 1946 then in 1947/50 the ones in Kilvert Road, Jubilee court and Belmont Road. In fact the flats behind Jubilee court are the oldest of the Newton Farm flats.

    The prefabs in Hunderton were built for families who were bombed in the cities and the men were demobbed within the Marches area.

    The bungalows in Beatie avenue built for injured servicemen and thier families.

    When I was born my mum had to catch a bus serving outlying villages, apparently Wednesdays and Saturdays.

    I had photographs of my Dutch uncle (no pun) working on the Cornish flats in Kilvert road.

  4. Well it was not meant to taken personally, I was merely pointing out the OBVIOUS reason behind putting the barbed wire across the top of this fence. I am aware of the law I am not sure this qualifies because where Glastonbury Close is at the back of the hotel it used to be fields and the hotel and the fencing at the back was definitely there way before Glastonbury Close, the reason I know this is my uncle has lived in Golden Post for over 40 years and we were only recently discussing the corn field that used to be there. So if the hotel was there before the Close why should this law apply and what is the purpose of barbed wire anyway?

     

    I am in agreement with Alex, barbed wire across the top of the fence is there to stop people climbing over that's the whole point. It will be interesting to see if any councillors can shed any light on Alex's comments above because I think he may have a valid point.

    Think about the gradient.....it would have to go on...and on...and on....!!!!

     

    Surely the shared space idea is more pedestrian friendly for the able and not so able bodied???

    Yes, I am all for shared space but you get wet when it rains etc a footbridge would come out of the 2nd level, Debenhams or something, most places have these coming from the 2nd floor which these days always has disabled access across into the top floor of Tesco (and yes there is one) or directly into Maylords and this is fraction of the distance they have at Cabot Circus

  6. I think I speak for most when I say it's not about "saving" buildings. It's about looking after them so they don't go to **** in the first place. Oxford is packed with historic buildings and it fills the city with character because they are maintained and not left to rot as most things are in Hereford. Look at the Left Bank, that was a complete new build, left to to rot just like everything else. So it doesn't really matter if the building is torn out and something modern put in it's place, the council will fail to look after that as well. 

     

    How can the council be at blame for the left bank, it is privately owed just like the eye sore in town!

I concur with Colin's findings, the traffic problem is only for southbound traffic where the traffic lights are in place, when we drove into town this morning it took 12 mins from Newton Farm junction by St Francis to Commercial Road opposite Fusion nightclub, which is pretty good and I put this down to the traffic lights being off north, so this says to me that the traffic lights are definitely causing the traffic congestion

     

    I agree too, traffic issue is only where they have temp lights in place and why only on that exit?

  8. Well in fairness to our Councillors I actually emailed them all invites over the weekend, these are the ones who have chosen to register and join HV, so lets cut them a little slack eh.. otherwise they will be gone before they have chance to say or do anything!  :Surprised_32: 

     

    Ditto and welcome to HV Councillors, lets hope you can help out as much as Cllr Vaughan-Powell has over the years on here. I would like to extend my warmest wishes and welcome you all.

  9. I thought that you were the BRPC Clerk or has your job description changed to Councillor? Surely if we are not happy or want to air our views we would contact our ELECTED Councillors? I don't remember electing you to be fair.

     

    Colin, as per usual you can guarantee that this will be a half hearted job and of course they are not going to give lights to a footpath that would be asking too much lol :Thumbs-Down:

     

    I had the same thoughts exactly.

     

    This area needs to be illuminated during the hours of darkness and LED light would be ideal as they do not pollute the surrounding homes only the footpath beneath.

    These two are clearly near the old garages on the GWW (opposite the Oval shops) most of the dead post locations are on each picture. The first post is actually on the GWW near the Hunderton bridge where the bank rises, most of these are obvious to be fair, get amy to log in here they will soon see where they all are like you say poor excuse indeed, just glad nobody has hurt themselves.
