I've never shopped in Zabka but I would guess they weren't producing a suspicious can of beer from under the counter if you gave a special wink or were a well known customer. I still haven't seen any suggestion that they were infringing any alcohol rules. But obviously you shouldn't be holding a booze licence if you are carrying out other criminal activities. Bilbobobby Posted March 23, 2016 Report Share Posted March 23, 2016 The guidance issued under section 182 Licensing Act 2003 covers licensing reviews. Within this part of the guidance it lists a number of criminal activities that the Home Secretary has decided as serious and as such the police or other responsibe authorities should consider using the review process to deter such conduct. If a review is launched, the regulatory committee should consider revocation even if the first occasion. Activities covered (summary) include location for criminal gangs; child exploration, drug dealing, illegal alcohol/tobacco, pornography, employment of illegal immigrants..there are more named... So the principle to use this process is to check if the premises has a licence to sell alcohol. If it does not or is purely licensed for late night refreshment or regulated entertainment from a licensing point of view NOTHING can be done. I am not aware of any laws which can close a shop if not a licensed premises if caught selling non duty paid or illegal alcohol or tobacco. So if a premises looses it's licence to sell alcohol and continues to sell such stuff it will be down to the local Trading Standards office to take action, that's their remit, they have additional powers and are expected to take appropriate action supported by the police and others. West Mercia Police said before the committee meeting that it has evidence the latest applicant “has connections†with those involved in the sale and supply of illegal tobacco. The county’s trading standards team feels the same. So armed with an existing suspicion, and obviously cheesed off with the committee decision to give him a licence, you would think Zabka would be #1 shop on the list for Trading Standards to keep an eye on. So why was he allowed to sell his illegal tobacco for 12 months before he got raided? I think TS might have been a bit unlucky when they went in as the amount of stuff recovered is barely more than a personal use quantity. The ONLY real Polish (owned) shop in Hereford as far as we are aware is Edysia right at the bottom of Eign Gate and the windows are not covered here as they have nothing to hide. Alex Posted April 9, 2016 Report Share Posted April 9, 2016 Within a few weeks the same owners of these shops have a applied for a booze licence next door in Kubus, only one of the others owners has actually completed the application, this is all a front. I thought Kubus was already selling alcohol?
