Fraudulent banks, utility companies and corrupt courts

That's quite an interesting turn of events.

 

The Magistrates Court case was adjourned on, or about, 12th Sept for 42 days so that paperwork could be collated about the disputed ownership. This takes us to about 24th October. [see post above from 12th Sept.]

 

So I don't know what case this is about. Maybe some parallel civil case? None of this stuff is being covered in the local paper as you suggest.

Watching Last Week Tonight with John Oliver on Sky Atlantic. He was highlighting Civil Forfeiture in USA where the police seem to be taking asset seizure to a new level - legalised robbery. In this country we have a similar scheme to remove assets accrued through crime, but in more increasing cases, in the USA, no crimes have been committed. Sounds a bit like the Guy Taylor scenario. Are we moving in this direction?

TWO Herefordshire farmers are among 2,000 business owners set on ‘bullying the banks’ to give small companies a better deal.
 
Will and Frances May are part of the organisation Bully Banks, and this month attended its conference in London on behalf of 37 farmers who claim to have been mistreated by high street banks and secondary lenders.
 
Frances May said: “The banking industry has changed radically in recent years and the public would be shocked if they knew the full extent of what has been going on since the crisis in 2008.
 
“The farmers we are working with were deliberately targeted by their bank, and these people have been subjected to serious wrongdoing.
 
“Without exception, they are hard working, straightforward and honest people, and have not deserved the treatment they have received.â€
 
The Mays – whose own business was challenged in 2010 by a sharp rise in feed prices – responded by launching their own brand of local free range eggs in order to turn their business around.
 
However the stories of many of the farmers they represented follow a different path.
 
At the conference, Will May presented case studies of five farmers who had been mistreated and described what he had seen as wholly unacceptable, deeply worrying and even criminal.
 
The conference brought together those who have affected, and featured specialist talks from two leading law firms, Berg of Manchester and Shakespeare’s of Birmingham.
 
However Ms May added that the role of increased internet usage in rural area had a significant role to play in uniting farmers, most of whom belong to the ‘small- and medium-sized business’ category.
 
She said: ““It is thanks largely to the power of the internet that victims are no longer isolated, are now able to talk and work together.
 
“With the election due to take place next year, this is an issue which will challenge the political allegiance of grass roots voters.
 
“This was demonstrated at last weeks’ by-elections and I believe it underlines the need for traditional standards and values to be maintained and upheld in Britain today.â€

Another section of society getting a rough deal and no justice. It is not only the Council using gagging orders to keep people quiet, but also the banks. This is an issue that affects over 40,000 small and medium sized buisinesses in the UK i.e. over eighty thousand people in the UK.

Talking with Guy Taylor in Birmingham at the weekend here is an update:

 

In August Guy Taylor was removed from Bodenham Manor and charged under the Legal Aid and Sentencing Act 2012 as being a trespasser, this charge claimed is clearly nonsense and unsupportable so he made an application that the CPS present proof of ownership documents to support their charge, they were given 42 days by the judge which was up on October 22nd.

 

On the 16th of October the CPS made an application in Worcester Magistrates for an extension of time as "the prosecutor dealing with this had been on holiday" which again is total nonsense and they are just trying it on, if they havent already got this evidence then on what basis was Guy Taylor charged in the first place! Anyway the judge gave them until November 7th to produce them so it will be most interesting to see what they will come up with on Friday at Hereford Magistrates Court.

 

Also when he was first carrried out of Bodenham Manor on April 2nd 2014 by numerous police and bailiffs they used a fraudulent writ to remove him, that means that his removal was unlawful and the physical carrying of him off the property was assault. He successfully laid the information for this before the Court on October 8th and the director of the bailiff company (UK Evict) Michael Anderson has been summoned to appear in Hereford Magistrates Court on November 19th charged with assault (further charges concerning the fraudulent writ are being processed).

Blimey.

 

I wonder if there is an end in sight now to this whole saga?

 

What will happen to the chap who thinks he has legally bought Bodenham Manor? He must have paid a pretty penny for it, and really seems to be an innocent victim caught up in the middle of all of this.

 

If you buy a car, and it later turns out that finance is owed on it, it is removed, and you are out of pocket. Would this be the same with this property??

Thanks for the update .... What is the point of a 42 day lay off and then a holiday excuse crops up? Just a very broken system here I think ....

Guy Taylor's hearing this Friday (7th November) appears to be in chaos as the courts were in confusion as to where the hearing was to be held. No CPS at Hereford and following various phone calls by officials, Guy was advised to be available until 4pm. Still no advice from courts so Guy Taylor will be at the magistrates court on Monday to follow this up.

Shambolic. Whatever the rights and wrongs of this case the defendant appears at all stages to co-operate with the Court process .... Then the process breaks! Hope they knock this off any costs that he possibly might incur!

Roger, not sure what you mean by "appears to co-operate with the Court process". I think he has had to fight to prove the claims brought against him are fraudulent and if the court wants to delay matters, so justice can be done, then it is a price worth paying. After all the ball is in the CPS's court and they appear unable to provide evidence against Guy Taylor as requested by the judge over 42 days ago. When they present that evidence then it will open to scrutiny and proper legal decisions made.

'appears to co-operate with the Court process' ~ I've just seen internet reports ... Guy Taylor appears to me to be turning up when required. I wasn't at the Court to see his appearance and I don't work at the Court. I'm not questioning his right to dispute his Charge ... My point was more of a swipe at the Court process. Crime is allegedly going down a lot and 'out of Court disposals' seem to be eroding the workload of the Courts ... So why does everything still take Months/Years to sort out?

Update with Guy Taylor today on UK Column News 17th November 2014 starts at the beginning.

 

 

I started watching that ... The presenter said today's show was 17th December ... Strange as that is a month away ... Guy Taylor then starts rambling about loads of stuff ... When is the squatting trial starting? That's all I'm interested in ... The dispute over the gas/electric is just not relevant ... It's old news ...

December 17th is a mistake. You obviously didn't listen to what he says -you need to stick with it to the end of the interview. The delay is on the part of the CPS refusing to submit the evidence requested by the judge. They were asked to produce the evidence before the judge on November 10th, but because of a cock up at the Magistrates Court, the CPS didn't turn up and there was no judge to make a ruling. Following this Guy Taylor was sent a bundle of CPS documents, none of which were the documents the judge has requested, so Guy Taylor is returning to court on the 3rd December before the same judge to get the case dismissed. Where it goes from there I do not know other than he has private prosecutions against several individuals to follow.

 

Rather than research for yourself what is going on you appear to just want to get to a verdict staright away. I am sure Guy Taylor does, but the police, courts and its officials appear to be putting a lot of obstacles in his way to get this resolved.

Thank You ... I know some cases are more difficult than others but justice delayed is not justice served in my opinion ... I do think tho that Guy Taylor has a Mission against the system ... I think he needs to sort all his current stuff out then move on .... Life is too short ...

As I understand it, Mr Taylor was charged with trespass at Bodenham Manor after he was originally evicted in April, subsequently reoccupied it and was removed from the property again in August. The charge assumes that following the original eviction, he is no longer the owner of Bodenham Manor. Mr Taylor's defence is that the eviction was fraudulent and he is still the owner and thus he could not be guilty of trespass. The judge has ordered that the CPS provide evidence of ownership.

 

Separately, Mr Taylor brought a private prosecution for assault against the bailiffs that evicted him from Bodenham Manor in August. The charge seemed to be based on the assertion that since the original eviction was fraudulent the bailiffs were acting unlawfully by removing him. However, as they are entitled to do, the CPS took over and discontinued the case.

 

Essentially both cases hinge on the validity of the original and subsequent evictions. Given that the private prosecution has failed one must wonder about the remaining case.

The private prosecutions have not taken place yet as far as I am aware. The validity of the documents concerning Bodenham Manor are still in question.

 

In 03.15 to 04.15 of the "UK Column" video you posted Mr Taylor says that Mark Poole of the CPS has reviewed Mr Taylor's private prosecution for assault against the director of the bailiff company "and decided drop it". The CPS has the power to do this if it considers that there is little chance of conviction or for example it considers the case to be malicious or vexatious.

 

Later in the video Mr Taylor talks about a Mr Ebert who is also facing eviction from his current property. In many ways Mr Taylor's experiences mirror those of Mr Ebert who spent many years trying to prove that his bankruptcy and eviction from his previous property were the result of fraud and collusion by the judicial system etc. but without any success.  Mr Ebert brought possibly more than a hundred private civil and criminal prosecutions to try to prove his point, to the extent that he was ultimately judged to be a "vexatious litigant" and banned in perpetuity from bringing any more prosecutions without the advance permission of the High Court. Mr Ebert is currently providing "forensic document analysis" to Mr Taylor and others to identify fraudulent documents and judicial process.

The judge in this Bodenham Manor eviction Court case originally gave the parties 42 days to gather together their documents about the ownership of the property. Why didn't they do that and crack on? This seems to be dribbling on ad infinitum. For no good reason in my view.

Vexatious in our council terms - and related to what you are talking about - but we "here" are not really allowed to talk about means :

In my understanding : 

 

A person who calls many different departments, speaking to many different council staff over the same issue repeatedly without really knowing what he is talking about.

 

That would be considered vexatious.

 

And to be fair - I would agree.

I think I know what you are referring to, we have crossed wires here, I should have been clearer in my post. I was thinking about Paul Cardin, being labelled as this, whilst attempting to gain information using The Freedom of Information Act.
